Welcome to ColorYourPast. These Terms of Service ("Terms") govern your access to and use of the ColorYourPast website and services (collectively, the "Service") operated by ColorYourPast ("Company", "we", "us", or "our"), registered in Bulgaria.

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

1. User Obligations

By using ColorYourPast, you agree to:

• Provide accurate and complete information when creating an account
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access to your account
• Be at least 18 years old or have parental consent to use the Service
• Comply with all applicable laws and regulations in your jurisdiction

2. Acceptable Use

When using ColorYourPast, you agree NOT to:

• Upload, colorize, or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Upload content that infringes on the intellectual property rights of others
• Use the Service to process images containing child exploitation material
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use automated tools, bots, or scripts to access the Service without our express permission
• Interfere with or disrupt the integrity or performance of the Service
• Reverse engineer, decompile, or attempt to extract the source code of our technology
• Use the Service in any manner that could damage, disable, overburden, or impair our servers
• Resell, redistribute, or commercialize access to the Service without authorization

Violation of these acceptable use policies may result in immediate termination of your account and potential legal action.

3. Intellectual Property Rights

Your Content

You retain full ownership of your original photos and the colorized versions created through our Service. ColorYourPast does not claim ownership over any images you upload or the colorized results.

By uploading photos to ColorYourPast, you grant us a limited, non-exclusive, royalty-free license to:

• Process your images through our colorization technology
• Store your images securely on our servers
• Deliver the colorized images back to you
• Create backups necessary for service operation

This license is solely for the purpose of providing the Service to you and terminates when you delete your content or account.

Our Content

The ColorYourPast name, logo, website design, and underlying technology are the intellectual property of ColorYourPast and are protected by copyright, trademark, and other intellectual property laws. You may not use our branding or technology without our written permission.

Usage Rights

You are free to use your colorized images for any purpose, including personal use, social media, prints, and commercial projects, unless prohibited by your local laws. We place no restrictions on how you use the colorized versions of your own photos.

4. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the fullest extent permitted by applicable law, ColorYourPast disclaims all warranties, including but not limited to:

• Merchantability and fitness for a particular purpose
• Non-infringement of third-party rights
• Accuracy, reliability, or completeness of the colorization results
• Uninterrupted or error-free operation of the Service
• Security of data transmitted through the Service

IN NO EVENT SHALL COLORYOURPAST BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Any damages resulting from unauthorized access to or use of our servers
• Any damages resulting from interruption or cessation of the Service
• Any bugs, viruses, or similar harmful code transmitted through the Service

Our total liability to you for any claims arising from your use of the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

5. Indemnification

You agree to indemnify, defend, and hold harmless ColorYourPast, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Any content you upload to the Service
• Any activity conducted through your account

This indemnification obligation will survive the termination of your account and these Terms.

6. Dispute Resolution

Governing Law: These Terms shall be governed by and construed in accordance with the laws of Bulgaria, without regard to its conflict of law provisions.

Jurisdiction: Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively in the courts of Bulgaria. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.

Informal Resolution: Before filing any legal claim, you agree to first contact us at legal@coloryourpast.com to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 30 days of receiving your notice.

Class Action Waiver: To the extent permitted by law, you agree to resolve any disputes with us on an individual basis and waive any right to participate in class action lawsuits or class-wide arbitration.

7. Service Disclaimers

AI-Powered Colorization

ColorYourPast uses artificial intelligence technology to colorize photographs. While we strive for accurate and realistic results:

• Colorization results are AI-generated interpretations and may not reflect historical accuracy
• Colors applied to images are based on algorithmic predictions and may differ from original colors
• Results may vary depending on image quality, resolution, and content
• We do not guarantee satisfaction with colorization results

Service Availability

We make reasonable efforts to maintain Service availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

• Scheduled maintenance and updates
• Technical issues or server problems
• Circumstances beyond our reasonable control

Third-Party Services

Our Service integrates with third-party services (including payment processors and printing partners). We are not responsible for the actions, content, or policies of these third parties.

8. DMCA Takedown Procedures

ColorYourPast respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). If you believe that content on our Service infringes your copyright, please submit a takedown notice to our designated agent:

9. Account Termination

By You: You may terminate your account at any time by contacting us at support@coloryourpast.com. Upon termination, we will delete your data in accordance with our Privacy Policy.

By Us: We reserve the right to suspend or terminate your account immediately, without prior notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment of fees
• Extended periods of inactivity
• Any reason we deem necessary to protect the Service or other users

10. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date at the top of this page. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
